General Terms and Conditions
GENERAL INFORMATION
The following sales conditions are applicable to offers and/or agreements between Exalto Emirates LLC SP (VENDOR) and the customer (BUYER). Any purchase from VENDOR by BUYER implies the BUYER's express acceptance of these conditions. Minor customers (under the age of 18) shall not register as a user of the website and shall not transact on or use the website. The cardholder must retain a copy of transaction records and Exalto Emirates LLC SP website policies and rules. Users are responsible for maintaining the confidentiality of their account information and login credentials. We also accept an uploaded Purchase Order from customers who have a credit approval from us. Exalto Emirates LLC SP maintains the website: www.exalto-emirates.com
PRICES
Prices are intended ex-works, net of transport, port and insurance costs. Prices do not include any V.A.T.
PAYMENT
Exalto Emirates LLC SP accepts Visa and MasterCard debit and credit card payments in AED.
The displayed price and currency at the checkout page will be the same price and currency shown on the transaction receipt. The amount charged to the card will be shown in the cardholder's card currency, subject to any applicable currency conversion or charges applied by the card issuer.
SANCTIONS AND RESTRICTED TRANSACTIONS
Exalto Emirates LLC SP will not trade with or provide products or services to countries, territories, individuals or entities that are subject to applicable OFAC sanctions or other applicable sanctions and trade restrictions.
DELIVERY DATES
The delivery dates are always intended as "indicative" and the agreement shall remain fully and unconditionally effective whatever the actual delivery date. In no case shall failure to respect the quoted delivery date give rise to any right to compensation.
DELIVERY / RETURNS
Exalto Emirates LLC SP shall proceed with transport on behalf of and at the expense of the BUYER via the method selected at checkout. All transport, including carriage paid delivery, is at the BUYER's risk. The VENDOR will only insure the goods for shipment at the expense of the BUYER at the specific request of the BUYER. It is the BUYER's responsibility to check the condition and nature of the goods on arrival. Any loss or breakage found must be notified to the carrier within three days, via registered letter with advice of delivery. Any materials not collected within 30 days after notification to BUYER that order is ready to be shipped/ collected shall be returned to stock and are subject to 10% restocking charges.
Any complaints relating to deliveries not corresponding to the order must be made immediately to Exalto Emirates LLC SP and confirmed in writing within eight days of receipt of the delivery. In the absence of such a complaint, Exalto Emirates LLC SP shall be exonerated from any liability to the BUYER.
Goods which need to be returned will only be accepted subject to prior agreement in writing from Exalto Emirates LLC and if returned from outside the United Arab Emirates must arrive free of any duties and charges. The maximum period for return of any goods is 30 days from date of purchase.
WARRANTY
The VENDOR warranties that its products are free from manufacturing defects and flaws in the materials for a period of one year from delivery. In case an extended warranty is required for boat builders this needs to be indicated at time of enquiry and in any case prior to confirmation of order. Certain manufacturers provide longer warranty periods than the standard 1 year and this information will be provided upon request by the BUYER. Defective parts will be repaired free of charge or, at the sole discretion of the VENDOR, replaced; transport and/or dispatch costs shall always be the responsibility of the BUYER. Any removal or installation costs and/or dry docking expenses are expressly excluded. This undertaking by the VENDOR excludes all other effects of the guarantee provided for by law. The Exalto Emirates LLC SP guarantee is not applicable to replacements or repairs resulting from normal wear of the material, from its defective use, from failure to respect the instructions for use or maintenance, from defects in maintenance or supervision, or from faults deriving from the use of spare parts or materials which do not originate from Exalto Emirates LLC SP. Furthermore, this guarantee will cease to have effect in the event that the BUYER carries out repairs or modifications himself or has such work carried out by third parties without the written consent of Exalto Emirates LLC SP.
THIRD PARTY LIABILITY
The VENDOR is relieved of all responsibility for all direct or indirect damage and loss of income, which may result from breakdown or defects in the goods supplied. The VENDOR is expressly exonerated from all responsibility and liability for any accidents or damage to persons or property which may occur as a result usage of the delivered goods. This also applies if the accident or damage results from manufacturing or material defects.
PRIVACY POLICY
Exalto Emirates LLC SP takes appropriate steps to ensure the privacy and security of information provided through www.exalto-emirates.com, including through appropriate hardware and software methodologies. However, Exalto Emirates LLC SP cannot guarantee the security of any information disclosed online.
Exalto Emirates LLC SP is not responsible for the privacy policies of third-party websites to which www.exalto-emirates.com may link. If information is provided to such third parties, different rules regarding the collection and use of personal information may apply. Customers should contact the relevant third party directly if they have any questions regarding the use of information collected by them.
CHANGES TO WEBSITE POLICIES
The Website Policies, Privacy Policy and Terms & Conditions may be changed or updated from time to time to meet applicable requirements and standards. Customers are encouraged to review these sections periodically to remain informed of any changes. Any modifications will become effective on the date they are published on www.exalto-emirates.com.
APPLICABLE LAW AND PLACE OF JURISDICTION
The sales agreement and the general conditions of sale are subject, and hence regulated, by the laws of the United Arab Emirates and any disputes arising will be settled by the courts in the United Arab Emirates.
